The European Commission is to take Ireland back to the EU Court of Justice for not carrying out an environmental impact assessment of the Derrybrien wind farm in Co. Galway.
70 turbines were constructed at the site 13 years ago making it the biggest windfarm in Ireland, but no proper environmental impact assessment has been carried out.
Under EU law, a study is required for projects of this size before construction can commence.
The European Commission is requesting that the EU Court of Justice impose a minimum lump sum fine of almost 1.7 million euro, and a daily penalty of over 12,000 euro if full compliance is not achieved by the date when the court issues its ruling.
